1. Agreement and scope
These terms govern services purchased from J Beard Graphics, LLC ("J Beard," "we," or "us"). "Client" means the person or business identified as the purchaser on the order or written proposal. A person booking for a business represents that they have authority to bind that business.
The accepted order, package description, and any agreed written project-specific terms identify the services, deliverables, price, and permitted use. A signed project-specific agreement controls a conflict with these general terms. Changes require written agreement. Only services expressly included in the accepted order are included; sample images and videos illustrate style and do not guarantee identical results.
These terms must be presented and accepted before payment or work begins, including appointments entered by our team. Merely visiting our website does not place a service order. Changes to these terms apply to future orders unless otherwise expressly agreed.
2. Booking, payment, and order corrections
Online orders are payable in full at the final booking step. When our team creates an appointment and authorizes payment after the shoot, the balance is due before media downloads or usage rights are released. Custom invoices follow their stated payment schedule. Approved commercial projects may require 50% before work begins and the remaining 50% when completed media is ready for delivery, before release of downloadable files, unless the written proposal states otherwise.
The client must provide accurate property type, square footage, bedroom count, acreage, address, and requested coverage. If incorrect information places the property in the wrong published pricing tier, we may correct the appointment to the applicable tier and notify the client of the calculation. Any additional balance is payable before downloads. A resulting overpayment will be refunded or credited with the client's agreement. Material scope changes and services outside the published tiers require approval before additional work.
Travel, additional locations, amenity coverage, extra structures, return visits, and work beyond the selected package are included only when stated in the order. Additional charges will be disclosed before they are incurred. Possession of a stored payment method does not by itself authorize new charges; automatic payments require the applicable payment authorization.
3. Property preparation and access
The client must have permission from the owner or authorized property manager for entry, photography, video, drone operations where applicable, and the agreed use of the resulting media. The client is responsible for arranging access to gated communities, amenities, common areas, and other requested locations, including required permissions and access fees disclosed in advance.
Properties are photographed as they appear at the appointment. Cleaning, decluttering, staging, repairs, landscaping, and removal of personal or sensitive items must be completed before arrival. Follow the preparation checklist supplied with the booking. Our team may make minor adjustments at its discretion but is not responsible for moving furniture, cleaning, staging, or concealing property conditions.
We prefer the property to be unoccupied during the shoot. Arrange for occupants and pets to be away from the areas being captured. An authorized representative is optional when reliable unattended access has been arranged. Provide a working lockbox code, the required seven-digit Call Before Showing (CBS) code for compatible electronic lockboxes, or permitted one-time access assigned to the photographer's phone number. Provide access information securely before the appointment.
Communicate required features, excluded spaces, privacy concerns, and special instructions in writing before the shoot. In the absence of specific instructions, we use professional judgment on composition and coverage within the purchased scope. The absence of a representative does not waive the client's right to report our errors.
We may pause or decline work involving unsafe conditions, unsecured animals, harassment, unlawful access, or conditions that could damage equipment or endanger people. We will explain the issue and available next steps.
4. Cancellation, rescheduling, and unsuccessful visits
Cancellation notice is measured from the scheduled start time, using Central Time. Contact us by email or text using the contact details below, or through the available booking cancellation function. A timestamped request counts when received; our delayed acknowledgment does not move it into a higher fee window.
| Notice for cancellation | Fee |
|---|---|
| At least 24 hours | No cancellation fee |
| Less than 24 hours, but at least 2 hours | $50, capped at the booked service charges |
| Less than 2 hours, or an unsuccessful visit caused by unavailable access or an unready property | 50% of the booked service charges |
Only one cancellation/unsuccessful-visit fee applies. These charges are intended to reasonably compensate reserved time and disruption, not impose a penalty, and apply only to the extent permitted by law. We refund prepaid amounts exceeding the applicable fee and any separately approved, completed work; we do not charge twice for the same loss.
Rescheduling is handled separately. We consider notice, location, routing, travel already undertaken, and crew time. A location-based rescheduling or return-trip charge will be disclosed and accepted before confirming the replacement appointment. No undisclosed discretionary fee applies. If a cancellation or unsuccessful-visit fee was charged, it will be credited against any charge covering the same wasted visit.
We may leave after 20 minutes if access or readiness cannot be resolved. We may instead complete the accessible, ready portions with client authorization. Additional visits require an agreed quote. If we cancel for reasons within our control, we will offer rescheduling or refund the unperformed services without a client cancellation fee.
5. Weather and aerial services
If forecast weather is unsuitable for exterior, aerial, or video work, we will advise moving the entire appointment to a suitable day. Rescheduling the entire shoot for weather carries no fee.
If the client elects to proceed with available portions despite that advice, completing the remaining work on another date will require a location-based return-trip fee. We will disclose the fee and obtain approval before proceeding on that basis. Unexpected weather-related return arrangements will be discussed and priced before an additional visit is confirmed.
Drone work depends on safe weather, airspace permissions, visibility, site conditions, and lawful flight access. The pilot makes the final safety and flight decision. Specific flight paths, altitudes, views, or clearance approvals cannot be guaranteed. If a purchased aerial service cannot be performed, we will agree on a later date, an approved substitute or credit, or a refund of the undelivered component's allocated price. No substitute will be imposed without agreement.
6. Delivery
Delivery timing begins when capture of the relevant service is complete. Media may be delivered in stages through our client portal or another agreed delivery method. Payment holds restrict access even when processing is complete.
| Service | Standard delivery target |
|---|---|
| Photography and Video Walkthrough | Within 24 hours |
| Standard and enhanced 2D floor plans, 360 tours, and virtual staging | Within 24 hours after capture or receipt of all required materials/instructions |
| 3D floor plans | Up to 48 hours |
| Third-party platform media, including platform-specific 3D tours and floor plans | Usually within 24 hours; availability depends on the platform’s processing and publication |
| Social Media Teaser, Property Showcase Film, and Aerial Video Showcase | 2–3 calendar days, with Sundays excluded from the count |
| Agent Content and custom commercial projects | The schedule agreed for that project |
Enhanced 2D floor plans included with a 3D floor plan order are delivered within 24 hours; the 3D floor plan may follow within 48 hours.
Friday photography is ordinarily delivered Saturday. Same-Day Photo Rush applies only to qualifying photography orders and targets delivery by 8 p.m. Central Time that day; delivery may run later that evening. It does not accelerate videos, tours, or third-party processing. If rush photos are not ready that calendar day for reasons within our control, we refund the rush surcharge.
We will notify the client of material delays caused by outages, illness, weather, technical problems, or third-party processing and provide a revised estimate. These exceptions do not eliminate responsibility to provide paid services or an appropriate remedy for services we cannot supply.
7. Revisions and service concerns
Review delivered media promptly and send one consolidated written list of requests within three calendar days. Identify files and the exact changes requested. Requests received on days four through seven will be reviewed subject to the package's revision allowance and production availability. Requests received more than seven days after delivery may carry an editing or retrieval fee, disclosed before work.
Corrections to our errors are free, including when reported after these review periods. The review request does not waive rights that cannot legally be waived. New preferences, extra retouching, changes to the property after capture, replacement scripts, additional filming, and work outside the original scope may require a new quote. A revision does not automatically include a reshoot.
If we fail to supply agreed work, we will first seek to correct or reperform the affected service. If that is not reasonably possible, we will refund the affected service's allocated price. Completed, conforming work does not become refundable because the client changes plans, the property never lists, or a sale or rental does not occur.
8. Ownership and permitted use
J Beard retains copyright in media it creates, subject to any third-party rights. Payment purchases the stated services and a nonexclusive license, not ownership of files or copyright. Raw captures, unselected images, source files, and editable project files are excluded unless expressly purchased.
The license begins after full payment of the applicable order and permits:
- Listing media: Marketing the photographed property during the purchasing client's listing, including authorized brokerage distribution, MLS submission and ordinary listing syndication, followed by the client's portfolio and sold-property promotion.
- Vacation rental media: Marketing that property while the purchasing client owns or manages it. A new owner or manager must obtain a separate license.
- Agent Content: Ongoing promotion of the purchasing client's own professional brand, subject to disclosed music or other third-party restrictions.
- Commercial work: The uses specified in the accepted written proposal.
MLS, hosting services, rental platforms, and listing portals may display and technically process media as necessary for the authorized property marketing. This limited distribution permission does not grant unrelated businesses independent advertising rights or permit the client to transfer ownership of the media. Contact us before accepting platform terms demanding rights broader than this license.
Builders, designers, architects, stagers, title companies, sellers, buyers, subsequent agents, and other third parties must obtain written permission and any required separate license for their own use. Reimbursement of the booking client by a seller or another party does not transfer copyright or usage rights. Brokerage use is limited to the authorized property marketing unless otherwise agreed.
9. Image integrity and editing restrictions
Proportional resizing for technical display or upload requirements is allowed. Other alterations require prior written permission, including cropping, filters, color or exposure changes, object removal, sky replacement, additional virtual staging, AI transformations, video re-edits, and overlays that change the delivered media. Do not upload our media to third-party editors or AI services for alteration without approval. Ordinary placement of an unchanged image beside text or a logo in a marketing layout is permitted; alteration of the image itself is not.
Unavoidable platform compression, thumbnail generation, or automatic display cropping is not treated as a client edit. Request an approved alternate crop or format when necessary. No permission is granted for AI model training, stock resale, or unrelated reuse.
We may require unauthorized uses or edits to stop and seek remedies permitted by law. For a correctable license breach, we provide written notice and five calendar days to cure before suspension; urgent unlawful or harmful uses may require immediate action. A breach does not authorize penalties beyond those agreed or permitted by law.
10. Floor plans, boundaries, staging, and marketing accuracy
Floor plans, dimensions, square footage, and parcel outlines are marketing aids and may be approximate. They are not surveys, appraisals, architectural or engineering drawings, or guarantees of legal boundaries or usable area. The client must verify facts needed for a transaction through appropriate records or qualified professionals and supply reliable boundary information for requested outlines.
Virtual staging, digital twilight, and other purchased enhancements are illustrative. The client is responsible for required MLS and advertising disclosures and for using the appropriate original versions where required. We will not knowingly create materially deceptive representations of permanent property conditions. Clients remain responsible for factual claims, brokerage approvals, and the lawful use of supplied scripts, logos, and other client materials.
No service guarantees a sale, booking, lead count, engagement level, search ranking, or platform acceptance. Music and other licensed third-party assets may have channel or advertising restrictions disclosed with the project; ask before reusing them outside that scope.
11. Portfolio and publicity permission
Unless the client requests confidentiality in writing before capture, the client permits J Beard to display completed media in its portfolio, website, social channels, presentations, advertising, and professional submissions. The client confirms authority to permit the intended property use. A client appearing in the commissioned content also permits use of their own recorded likeness and voice for those purposes, without implying an unrelated endorsement.
The client cannot consent on behalf of people they do not represent. We will obtain appropriate separate permission for identifiable participants when needed, including guardian permission for minors. Property ownership or access alone does not supply every person's publicity permission. Agreed confidentiality or publication-embargo instructions control this section. Later privacy requests will be considered reasonably, but previously distributed print materials or independent third-party copies may not be recoverable.
12. File access and listing websites
Delivered media files will remain available through our client portal after the listing website is removed. The 12-month limit applies to the listing website, not to the delivered media files. Clients should also download and retain their own backup copies.
When a listing website is included with an order, it will remain active for 12 months from initial media delivery and will then be removed. Removal of the listing website does not delete the delivered media files or change the client’s usage rights under these terms.
Third-party tour and listing platforms control their own hosting availability and terms. Their hosted experiences are separate from the delivered media files retained in our client portal. If an included hosted service becomes unavailable during its agreed hosting period, we will make reasonable efforts to restore access or provide an appropriate substitute; if we cannot, an appropriate refund for the unprovided hosting portion will be offered.
13. Agent Content
Agent Content is scheduled and billed separately from property-media appointments. The one-time session is $995 and includes six edited vertical videos, captions, topic planning and talking points, up to two hours of guided filming, professional camera/lighting/sound, and one consolidated revision round. It has no recurring billing or three-month commitment.
The monthly package is $1,500 per month with an initial three-month commitment: three monthly payments totaling $4,500, eight edited vertical videos and five lifestyle photos per month, topic planning, and guided filming. One consolidated revision round per monthly batch is included. Delivery timing is confirmed before enrollment. Social publishing, account management, and ad spend are excluded unless purchased separately.
The first monthly payment is due at enrollment, with later charges on the disclosed monthly billing date. After the initial three months, service continues month to month. Cancel future renewal by email, text, or the available online cancellation control at least seven calendar days before the next charge. Later notice stops renewal after the upcoming paid month. Cancellation may be requested during the initial term to prevent renewal after month three; it does not automatically erase the remaining agreed initial-term payments. Any early release or settlement will be confirmed in writing. Statutory rights and remedies for our failure to perform remain unaffected.
We acknowledge cancellation and provide the final charge and service-end dates. Revocation of payment authorization stops future automatic charges; any legitimate remaining contractual balance is handled separately by invoice. An unambiguous cancellation through the payment platform will be treated as a cancellation request, not ignored because the client did not also contact us elsewhere.
Missed sessions: Give at least 24 hours' notice to move a filming session without a rescheduling fee, subject to availability. For shorter notice or a no-show, we will offer one replacement date when feasible and disclose any charge for additional travel or crew time before booking it. We will not impose both an appointment cancellation charge and a duplicate lost-session charge. Late arrival reduces available filming time unless an extension is agreed.
Unused sessions: One unused monthly session may move into the immediately following billing month, subject to scheduling availability; sessions cannot accumulate beyond that. The client must cooperate in choosing available dates. Client-caused unused allocations have no automatic cash value or refund. A paid, eligible final session may be completed within 30 days after the service ends without renewing. If our availability or cancellation caused the missed service, we extend the entitlement or refund the unprovided portion; it does not expire under this rule.
14. Email and text communications
We use order contact details for confirmations, scheduling, preparation instructions, invoices, delivery notices, and service-related support. These operational emails are separate from marketing subscriptions.
Email marketing is optional and selected through a separate opt-in. Subscribing allows J Beard to email service news, tips, availability, and promotions. Unsubscribe using the link in a marketing email or by contacting us. We honor opt-outs promptly and within legally required periods. A later booking does not automatically resubscribe an opted-out address. Declining marketing does not affect purchases or ordinary service emails.
Text messages require the applicable separate consent and are limited to appointments, customer service, delivery notifications, and information about scheduled services. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help, or contact us below. Text consent is not a condition of purchase. No promotional-text permission is granted by an email-marketing checkbox.
We do not sell or share mobile opt-in data or consent with third parties for their own marketing. Service providers may process necessary information on our behalf to deliver the requested messaging, subject to appropriate restrictions. Our separate Privacy Policy describes data handling; it must accurately reflect our actual providers and practices.
15. Responsibility, disputes, and general provisions
Contact us promptly so we can investigate and resolve concerns. This request does not eliminate payment-dispute rights or other rights provided by law.
To the extent permitted by law, liability for ordinary breach or negligence arising from a particular order is limited to the amount paid or payable for that order. Neither party is liable to the other for speculative lost sales, rental income, or indirect or consequential loss arising from ordinary breach. These limitations do not apply to fraud, willful misconduct, gross negligence, bodily injury, physical property damage caused by negligence, or rights and liabilities that cannot lawfully be limited.
Neither party is responsible for delays caused by events reasonably beyond its control, but it must notify the other and take reasonable steps to reduce disruption. If performance becomes impracticable, the parties will arrange a new date or refund unperformed services, accounting only for approved work actually completed.
Florida law governs, except where mandatory law requires otherwise. Disputes may be brought in courts with appropriate jurisdiction in Okaloosa County, Florida, subject to mandatory venue and consumer protections. No arbitration requirement or class-action waiver is imposed by these terms. An unenforceable provision will be limited or removed without invalidating the remainder. Failure to enforce a provision once does not waive it for later orders.
