TERMS & CONDITIONS
AT THE SHOOT
The Client is responsible for ensuring the presence of an authorized representative at the property during the scheduled photography session. This representative should have the authority to approve the Photographer's interpretation of the project. In the absence of such a representative, the Photographer's interpretation will be deemed acceptable and final.
All properties will be photographed in their current state ("as is"). It is the Client's responsibility to ensure that the property is photo-ready prior to the Photographer's arrival. This includes:

Removing personal items from countertops, tables, and other visible surfaces.

Completing all cleaning and staging activities.

Ensure that all areas to be photographed are accessible and free from obstructions.
While the Photographer may make minor adjustments, such as repositioning small items or removing stray objects, they are not responsible for cleaning, decluttering, or staging the property.
Upon scheduling the appointment, the Client will receive a digital pre-shoot checklist outlining recommended preparations to optimize the property's presentation. Adherence to this checklist is crucial for achieving the best photographic results.
The Client is encouraged to communicate any key features or focal points they would like captured during the session (e.g., custom finishes, architectural details, unique amenities). If no guidance is provided prior to or at the time of the shoot, the Photographer will use their professional judgment to highlight the most visually compelling aspects of the property based on their experience in real estate and architectural photography.
AFTER THE SHOOT
Once the images have been processed, the Photographer will perform digital retouching and deliver them to you by the next business day after the shoot, excluding weekends and holidays. Delivery is through our Client Portal or via WeTransfer to the email address you provide. All images will meet a minimum resolution of 3000 x 2000 pixels, suitable for internet MLS, and high-resolution images are also available in the Download section.
CANCELLATION, NO-SHOW, INCLEMENT WEATHER
A minimum of 24-hour notice is required for cancellation or rescheduling of the shoot. Any appointment canceled with less than 24 hours' notice will be subject to a $50.00 cancellation fee. Arriving 30 minutes late to an appointment will be considered a cancellation and billed at the total shoot rate. Every effort will be made to accommodate rescheduling. If an appointment is canceled on the same day within 5 hours of the scheduled time, you will be charged a same-day cancellation fee equal to 1/2 the total appointment price or a minimum of $150, whichever is greater. Cancellations within one hour of the appointment will be charged the full shoot rate, and a new appointment will need to be scheduled via our online scheduling service. If inclement weather prevents photography, a new date will be scheduled as soon as possible.
RIGHTS AND USAGE
All images produced for an Agent, Broker, or Homeowner (Client) may be used for any marketing material and campaigns associated with the property and for the Client's self-promotion for the duration of the listing. The client's parent company may also use the photos to market the specific property photographed. Ownership of the images remains with the Photographer, and a license is granted only to the Client and the Client's parent company, not to any third party. Any use of the images by a third party, including but not limited to architects, builders, stagers, designers, sellers, or buyers, is strictly prohibited unless approved in writing by the Photographer, and a licensing fee is collected.
IMAGE INTEGRITY, THIRD PARTY USE, AND EDITING RESTRICTIONS
The Client agrees not to alter, edit, crop, apply filters, or otherwise modify the delivered images in any way. This includes, but is not limited to, changes to brightness, contrast, color, composition, or the overall look and feel of the images.
Additionally, no third party—including virtual staging companies, image editors, contractors, AI websites and software, or other photographers—may alter or repurpose the images without prior written consent from J Beard Graphics, LLC.
If edits are required, the Client must submit a written request detailing the necessary modifications. All modifications will be performed solely by J Beard Graphics, LLC, or an authorized member of its team and may incur additional fees.
Unauthorized modifications, editing, or distribution—including by third parties—constitute a breach of this agreement and may result in immediate termination of usage rights, revocation of license, and potential legal action. J Beard Graphics, LLC reserves the right to seek damages and pursue remedies as permitted by law for any violation of these terms.
PAYMENT
Payment is due immediately upon scheduling to secure the appointment day and time. If payment has not been received within 24 hours of the appointment, you will be charged automatically on your stored payment method, or if no card is on file, the appointment will be canceled. Certain exceptions are made for commercial accounts, long-term clients, and Brokerages.
